Who pays for the change of ownership ?



Ans : Its very subjective . Normally , buyer of the vehicle pays for the cost of change of ownership of vehicle. So , while buying a used vehicle , cost of transfer should be kept in mind. In the cases where inter - state ownership transfer of vehicle , there is cost of getting NOC, Re-registration and Road tax as well , which is huge . Also in the states like Gujrat and Rajasthan , again  certain percentage of road tax of vehicle value is to be paid during transfer of ownership of vehicle.

How much time does RC transfer take ?

Ans : Time required for RC transfer varies from RTO to RTO . In some RTO RC transfer takes 2-3 days time , in some RTO it takes 25-30 days time. Approx. time to complete the process will be communicated to you by Itzeazy team in advance.


Is the seller presence required at RTO for vehicle ownership transfer ?


Ans : In normal scenario seller's presence at RTO is not required . Itzeazy provides door step service . However process varies significantly from RTO to RTO . So you need to check the exact requirement at particular RTO where vehicle is registered. Like inn Noida and Ghaziabad RTO seller's presence at RTO is mandatory for vehicle ownership transfer.  

In the scenario , when seller's signature on form 29 and 30 doesn't matches with the signature in the RTO record during vehicle registration , seller will have to visit RTO to clear the objection by RTO.

Is the buyer's presence required at RTO for transfer of vehicle ownership ?


Ans : Normally Buyer's presence is not required at RTO for ownership transfer of vehicle but there are cities like Noida, Ghaziabad, Hyderabad where buyer's presence is required . Ans : Yes, its necessary to do complete re-payment of loan on the vehicle before selling it .  The transfer of vehicle ownership can not be done if there is HP on the vehicle in the RTO records . 



I have purchased a second hand bike in Delhi and received all the necessary papers from the seller . Within how much time I should submit documents in the RTO office for transfer of ownership ?


Ans : The documents and forms for transfer of ownership should be submitted to the concerned RTO within 30 days from the date of purchase of the bike. Failing which you will have to pay Rs. 300 late fine per month . For car this fine is Rs. 500 per month.



I have a diesel car which is registered in Delhi . Its more than 10 years old. I want to change ownership of it in my father's name. Can it be done?


Ans : No. As per NGT order, a diesel vehicle can not be driven in Delhi-NCR after 10 years. Also no transaction can be done in the RTO  other than NOC . So, ownership can not be changed in Delhi.

​Vehicle in CO's name given it to me now I am retired want to get RC transferred in my name. what are the requirements?

​What is the procedure to transfer ownership of vehicle in case of death of registered owner ? Also what is the rule regarding nominee in RC ?


 Ans : The Ministry of Road Transport and Highways has made a few changes to the central motor vehicle rules of 1989 to make it easier for people who want to nominate a person in their vehicle registration certificate.

Before the new amendment took place, transferring a car to a nominee in the event of the death of the registered owner of a vehicle requires complying with a cumbersome procedures and frequent visits to different offices. The process was not uniform across the country.

When the owner of a motor vehicle dies, the person nominated on the registration certificate by the deceased or the person who succeeds to the ownership of the car can use the vehicle as his or her own for three months after the owner's death. For this, the individual must notify the registering authorities of the owner's death within 30 days of the death's occurrence.

Further, to transfer the vehicle in his or her name, the nominee will have to apply in form 31 within the period of three months from the death of the owner of the motor vehicle.

In case where the owner wants to change the nominee of the motor vehicle in case of contingencies like divorce or division of property, she/he may change the nomination.



If, the vehicle owner is not transferring the vehicle in his name after purchase then what action will be taken against the purchaser of vehicle to avoid any responsibilities after sell of vehicle?


Ans :  The vehicle owner may lodge complaint/FIR at the office of police authority regarding misusing / illegal using the vehicle without right ownership of vehicle and request to seize the vehicle till the transfer of vehicle in the name of buyer. The registered owner may submit the intimation along with copy of sell letter, RC and  complaint letter/ FIR of police authority for action taken, but liability will stand in the name of vehicle owner till the transfer of vehicle.

 

How much time it takes to transfer RC ?


Ans : Normally it takes 30 days time to transfer RC of vehicle. However, it varies from RTO to RTO. For exact information please visit concerned RTO office. 



What is the fine for RC transfer in Delhi ?


Ans : Late fine for RC transfer in Delhi is Rs. 500 in case of car and Rs. 300 in case of bike.



How can I transfer my RC car online ?


Ans : Application can be filled online. Fees can be paid online . However physical submission of application forms and supporting documents is required at RTO.

Following are the steps for RC transfer : 

  • Visit the official website of parivahan: https://parivahan.gov.in/parivahan/ 
  • Select ‘Vehicle related Services’
  • Select ‘State’ and input the ‘RTO number’, then click ‘Proceed’
  • Select ‘Apply for Transfer of Ownership, Change of Address, Hypothecation [Addition/Continuation/Termination], Duplicate RC)’
  • Enter your vehicle details as a Vehicle Registration No. and the last five characters of chassis number
  • Fill up the application detail carefully
  • Deposit Requisite RTO fees online
  • Take print of form 29, form 30 & RTO fees receipt

​As per motor vehicle act, transfer of vehicle ownership is mandatory in case of transfer of physical possession of the vehicle. 

There can be three possible scenarios under which RC should be transferred. ​

RC transfer process can vary depending on the scenario seller and buyer live in the same state or different state.


RC transfer within same state


Application for ownership transfer of vehicle can be submitted either to the RTO where vehicle is registered or to the RTO where buyer lives

If there is loan on vehicle , first HP termination has to be done in the parent RTO. After HP termination transfer of vehicle ownership application can be submitted to either the parent RTO or to the RTO where buyer lives



Inter state transfer of vehicle ownership
