I have purchased a used bike in Noida . Is it mandatory for seller and buyer to visit RTO for ownership transfer?

Ans : Yes . In Noida for  all kinds of RTO work , physical presence of the concerned party is mandatory for signature verification . For ownership transfer of bike, seller and buyer's presence at RTO Noida is mandatory .

I have shifted my car from Bangalore to Delhi recently . Its 2009 model car. I have taken the NOC from Bangalore and now want to register it in Delhi . What will be the procedure ?

Ans : As per National Green Tribunal directives, In Delhi NCR only Euro-6 vehicle can be registered . All cars in India manufactured before January 2020 were not Euro-6 compliant . So , this car can not be re-registered in Delhi.

How can I change ownership of the bike which is 2012 model and is registered in Delhi ? I live in Gurgaon .

Ans : In India bikes manufactured before January 2020 are Euro -3 compliant . So, the bike which you have purchased is Euro-3 compliant .As per National Green Tribunal directive re-registration of this bike ( ownership change from Delhi to Gurgaon involves Re-registration in Gurgaon) can not be done in Delhi NCR.

I want to remove hypothecation from RC of my car which is registered in Delhi ,but I dont live on the address mentioned on RC . What should I do?

Ans : In Delhi RC after RTO process goes by post . Its not possible to receive Rc by hand at RTO . So , Its advisable to go for change of address in RC along with HP termination.

I have a 15 year old car registered in Gurgaon RTO and it has been expired one month back . Can I apply for RC renewal ?

Ans : No, As per NGT directive , In Delhi NCR RC can not be renewed once it crossed 15 years.

What is the procedure to transfer ownership of vehicle in case of death of registered owner ? Also what is the rule regarding nominee in RC ?

Ans : The Ministry of Road Transport and Highways has made a few changes to the central motor vehicle rules of 1989 to make it easier for people who want to nominate a person in their vehicle registration certificate.

Before the new amendment took place, transferring a car to a nominee in the event of the death of the registered owner of a vehicle requires complying with a cumbersome procedures and frequent visits to different offices. The process was not uniform across the country.

When the owner of a motor vehicle dies, the person nominated on the registration certificate by the deceased or the person who succeeds to the ownership of the car can use the vehicle as his or her own for three months after the owner's death. For this, the individual must notify the registering authorities of the owner's death within 30 days of the death's occurrence.

Further, to transfer the vehicle in his or her name, the nominee will have to apply in form 31 within the period of three months from the death of the owner of the motor vehicle.

In case where the owner wants to change the nominee of the motor vehicle in case of contingencies like divorce or division of property, she/he may change the nomination.

The person referred to in sub-rule(1) shall apply in Form 31 within the period of three months to the said registering authority for the transfer of ownership of the vehicle in his name accompanied by:-

The appropriate fee as specified in rule 81;
The death certificate in relation to the registered owner;
The certificate of registration;
The certificate of insurance;
Driving License and permit in case of E-rickshaw and E-cart.

I have purchased a used car in Delhi. I have only rent agreement as address proof of Delhi. Can ownership transfer be done with rent agreement ?

Ans : For transfer of ownership of vehicle in Delhi, Rent agreement does not work. As address proof of buyer only adhaar card works.

I purchased a car 2 years back . There is loan running on the vehicle. I want to sell the car now. Can I sell it and repay loan later?

Ans: As per rule first you need to clear all the liabilities on the vehicle . Then after you can sell your vehicle .

My driving licence was issued from Kanpur and its paper DL . Currently I am in Delhi. Is Driving Licence renewal from Delhi possible?

Ans : Yes, your Driving licence from Delhi is possible . It will be 2 stage process :

Ans : No. You can not get DL without test in Bangalore. Driving licence test is mandatory to get driving licence. You will have to go through two types of driving test and clear it.

Ans : Yes, 16-18 years applicant can apply for driving license Without Gear Vehicle below 50CC capacity. At present 50CC vehicle is not available because the manufacturer are not producing less than 50 CC vehicles from about last 20 years.

What happens If I fail in the driving test?

Ans: You may apply for a re-test after 7 days. However this period of 7 days should be utilized to upgrade your skills and to rectify your mistakes.

I have purchased a used car in Delhi. I have only rent agreement as address proof of Delhi. Can ownership transfer be done with rent agreement ?

Ans : For transfer of ownership of vehicle in Delhi, Rent agreement does not work. As address proof of buyer only Adhaar works .

I want to apply for international driving licence in Delhi. My driving licence was issued from Kanpur . How can I apply for international driving licence in Delhi ?

Ans : International driving licence can be applied only from the city from where driving licence was issued. Since you are currently in Delhi, process will be like :

I have purchased a second hand bike in Delhi and received all the necessary papers from the seller . Within how much time I should submit documents in the RTO office for transfer of ownership ?

Ans : The documents and forms for transfer of ownership should be submitted to the concerned RTO within 30 days from the date of purchase of the bike. Failing which you will have to pay Rs. 300 late fine per month . For car this fine is Rs. 500 per month.
